Limited Warranty
LIMITED WARRANTY FOR LACROSSE® FIRETECH™ PRODUCTS
Limited Warranty. LaCrosse Footwear, Inc. ("LaCrosse") warrants to the original end purchaser ("Purchaser"), and to no other person or entity (including without limitation any direct or indirect transferee of the product from Purchaser), of each footwear product that bears the FireTech™ trademark that such product will be free from defects in materials and workmanship for a period of one-year from the date Purchaser purchased the product.

Exclusive Remedy; Repair or Replacement of Defective Product. If LaCrosse determines, after having the opportunity to evaluate the alleged defective product, that such product does not, in LaCrosse's sole judgment, conform to this limited warranty, LaCrosse will, at its option, either repair or replace the product without charge to Purchaser. LaCrosse shall have no liability or responsibility under this limited warranty beyond repair or replacement of the defective product, and repair or replacement of the defective product shall be Purchaser’s sole and exclusive remedy for breach of this limited warranty. LaCrosse makes no warranties, and expressly disclaims all warranties, with respect to any repaired product or replacement product.

Exclusions. This limited warranty does not cover, and LaCrosse shall have no obligation or liability with respect to, any damage or problems that result from:

  • Wear and tear, including wear holes, snags and worn stitching.
  • Failure to adequately maintain the product, including proper cleaning and leather conditioning.
  • Improper or inadequate fit (once product has been worn/used).
  • Products returned beyond the one-year warranty period, or used other than in the manner intended.
  • Damage caused by chemical or other foreign body contamination.
  • Use of any safety-toe boot after the boot has sustained an initial impact in excess of the specified ANSI rating for such boot. The safety toe may be shattered or otherwise damaged as a result of such impact and the boots should not thereafter be used in any environment that requires a safety toe.
  • Alterations, modifications or repair work performed by anyone other than LaCrosse.
  • Cuts, abrasions, or damage resulting from accident, neglect, abuse, misuse or from other than normal and ordinary use of the product.
Exercise of Limited Warranty Rights. If Purchaser purchased the product direct from LaCrosse, Purchaser must, to exercise Purchaser’s rights under this limited warranty, deliver, mail or ship the alleged defective rubber product (postage, shipping charges and insurance prepaid) to the following product specific address:

Rubber Fire Boots:

Returns must be within the one-year warranty period, together with a copy of a dated sales receipt as proof of purchase and a brief description of the warranty problem. If Purchaser purchased the product from an authorized LaCrosse distributor, then all warranty claims must be made through such distributor and Purchaser must, to exercise its rights under this limited warranty, deliver, mail or ship the alleged defective product (postage, shipping charges and insurance prepaid) to such distributor within the one-year warranty period, together with a written report setting forth the date of purchase and a brief description of the warranty problem. Purchaser or distributor, as applicable, must e-mail or call the LaCrosse Returns Department (customerservice@lacrossefootwear.com or 1-800-557-7246) and obtain a return authorization number ("R/A") before returning any alleged defective product to LaCrosse for evaluation. No returns will be accepted for evaluation unless the product is accompanied by a LaCrosse R/A and returned within 30 days of issuance of such R/A. Failure to comply with these procedures shall void this limited warranty.

Disclaimer of Unstated Warranties. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES AND REMEDIES, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. LACROSSE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. IF LACROSSE CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. THIS LIMITED WARRANTY SHALL NOT BE EXTENDED, ALTERED OR VARIED EXCEPT BY WRITTEN INSTRUMENT SIGNED BY A DULY AUTHORIZED OFFICER OF LACROSSE.

No Other Warranties. Purchaser acknowledges that any and all descriptions of the products, whether in writing or made verbally by LaCrosse or any employee, agent or other representative of LaCrosse, specifically including without limitation any and all descriptions and features of the products set forth in LaCrosse's catalog, are for the sole purpose of identifying the products and shall not be construed as express warranties by LaCrosse. Purchaser further acknowledges that no employee, agent or other representative of LaCrosse is authorized to make any other warranty, or assume any other liability, on behalf of LaCrosse, and that any statements or suggestions by LaCrosse, or any employee, agent or other representative of LaCrosse, regarding the use, application or suitability of the products shall not be construed as express warranties by LaCrosse.

Limitation of Liability. UNDER NO CIRCUMSTANCES SHALL LACROSSE BE LIABLE OR RESPONSIBLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE PAID FOR THE PRODUCT, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, ARISING FROM, OR IN ANY WAY RELATED TO, THE MANUFACTURE, SALE, USE, INABILITY TO USE, OR PERFORMANCE OF, ANY PRODUCTS PURCHASED FROM LACROSSE, NOTWITHSTANDING ANY FAILURE OF ANY OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY HEREIN. THIS EXCLUSION SHALL APPLY REGARDLESS OF WHETHER SUCH DAMAGES ARE SOUGHT BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR ANY OTHER LEGAL OR EQUITABLE THEORY.

State Law and Other Jurisdiction Rights. Some states and other jurisdictions do not allow the exclusion or limitation of indirect, special, incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions may not apply to you. This warranty gives Purchaser specific legal rights, and Purchaser may also have other rights, which may vary from state to state, or jurisdiction to jurisdiction.
